1. Scope The following General Terms and Conditions apply to all orders placed via our online shop ninesells.de by consumers and entrepreneurs.
2. Contracting Parties, Conclusion of Contract The purchase contract is concluded with Mono Jacobi (ninesells). The presentation of the products in the online shop does not constitute a legally binding offer, but a non-binding online catalog. By clicking the order button, you place a binding order for the goods contained in the shopping cart. The confirmation of receipt of the order follows immediately after sending by an automated email together with the acceptance of the order. With this email confirmation, the purchase contract is concluded.
3. Specifics of the Goods (Vintage & Second-Hand) Please note that our inventory consists of vintage and second-hand clothing. Age-related signs of wear, slight fading, or minor flaws are normal for these items and define the character of the pieces. These customary and age-typical characteristics do not constitute a defect. Specific defects will be documented in the respective item description to the best of our knowledge and belief.
4. Prices and Shipping Costs The prices stated on the product pages are final prices. According to § 19 UStG (German small business regulation), no value-added tax (VAT) is charged or shown. In addition to the stated prices, we charge shipping costs for the delivery. The shipping costs will be clearly communicated to you on the product pages, in the shopping cart system, and on the order page.
5. Payment In our shop, the payment methods displayed during the checkout process (e.g., credit card, PayPal, Klarna) are generally available to you.
6. Retention of Title The goods remain our property until full payment is made.
7. Transport Damage If goods are delivered with obvious transport damage, please report such errors to the delivery person as soon as possible and contact us immediately. Failure to make a complaint or to contact us has no consequences for your statutory claims and their enforcement, in particular your warranty rights. However, it helps us to assert our own claims against the carrier or the transport insurance.
8. Warranty and Guarantees Unless expressly agreed otherwise below, the statutory liability for defects applies. Since our items are used goods, the limitation period for claims for defects is reduced to one year from the delivery of the goods. Claims for damages as well as claims for defects that we fraudulently concealed remain unaffected by this reduction.
9. Dispute Resolution The European Commission provides a platform for online dispute resolution (ODR), which you can find here: https://ec.europa.eu/consumers/odr/. We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.
